Article – Right of Withdrawal, Returns and Refunds

(Wine Products)

1. Scope of Application

These provisions apply to all sales of wine products carried out on the website vinaventures.fr, to consumers within the meaning of the introductory article of the French Consumer Code.

The sale of alcoholic beverages is strictly reserved for adults (18 years of age and over).

2. Right of Withdrawal (Articles L221-18 et seq. of the French Consumer Code)

In accordance with applicable legislation, the customer has a period of fourteen (14) calendar days from receipt of the order to exercise their right of withdrawal, without having to provide any justification.

3. Exclusions from the Right of Withdrawal – Wine Products

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal may not be exercised in the following cases:

  • Products that have been unsealed after delivery (opened bottles or bottles from which the cork/capsule has been removed);

  • Products that cannot be returned for reasons of hygiene, food safety, or health protection;

  • Personalized or custom-made products (specific gift boxes, special orders);

  • Products sold on promotion, clearance sales, or during specific commercial operations;

  • Gift cards.

Any bottle that has been opened or unsealed is not eligible for return or refund.

4. Return Conditions

To be accepted, any return must strictly comply with the following conditions:

  • Be made within fourteen (14) days from notification of withdrawal;

  • Concern a product that is strictly intact, unopened, and unused;

  • Be returned in its original packaging, properly protected for transport;

  • Be accompanied by proof of purchase (invoice or order confirmation).

Any product returned incomplete, damaged, opened, or unsuitable for resale will be refused.

5. Return Procedure

No return will be accepted without prior written request.

The customer must contact customer service at contact@vinaventures.fr in order to obtain return terms and instructions.

Products returned without prior authorization will be automatically refused and sent back to the sender.

6. Shipping Costs and Transport Liability

Return shipping costs are entirely borne by the customer, except in the event of an error attributable to the seller (defective product, non-compliant product, order preparation error).

The customer is solely responsible for the choice of carrier for the return.
Any risk related to return transport (loss, breakage, damage) remains the customer’s responsibility until the parcel is effectively received by the seller.

7. Broken, Damaged or Non-Compliant Products Upon Delivery

The customer is required to check the condition of the parcel and bottles upon delivery.

In the event of a damaged parcel, broken bottle, leakage, or non-compliant product, the customer must:

  • Make clear and precise reservations with the carrier at the time of delivery;

  • Contact the seller within a maximum period of forty-eight (48) hours from receipt, by email at contact@vinaventures.fr, attaching supporting photographs (parcel, packaging, bottles).

After this period, no claim will be accepted.

8. Exchanges

No standard exchange policy is offered.

A customer wishing to obtain a different product must return the product in accordance with these conditions and then place a new, separate order, subject to acceptance of the return.

9. Refunds

After receipt and inspection of the returned product, the customer will be informed by email of the acceptance or refusal of the refund.

In the event of acceptance, the refund will be made using the same payment method as that used for the order, within a maximum period of fourteen (14) days from receipt of the returned product.

Initial delivery costs are not refunded, except in the event of an error attributable to the seller.

Bank processing times remain independent of the seller’s control.

10. Governing Law – Disputes

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the customer is invited to seek an amicable solution prior to any legal action.
Failing an amicable agreement, the French courts shall have exclusive jurisdiction.
